Trademark registration
A trademark is a sign intended to individualise a business's goods or services. Such a sign helps an entrepreneur promote their products on the market, increase their recognisability, and prevent unfair behaviour by competitors who copy brands or designs.
Classic examples of trademarks are word and figurative marks. For example, the brand names "McDonald's", "H&M" and "Samsung", as well as the logos of Apple, Nike and Adidas, are registered as trademarks.
A trademark is registered in respect of specific goods or services, the list of which is set out in the International Classification of Goods and Services (Nice Classification).
Basic requirements for trademark registration:
The mark has distinctive character
A trademark must not be descriptive and must not merely repeat the names of the goods or services for which it is registered.
Difference from already-registered marks
The mark must be sufficiently distinct from trademarks already registered for similar goods or services.
